General Rules

1.   Contestants must be children 13 years or younger.

2.   Contestants must be U.S. citizens or permanent residents.

3.   A parent or guardian must submit the Contestant’s completed application, including uploading the design entry and agreeing to the parental release and consent form, on behalf of each Contestant.

4.   Only one entry per Contestant may be submitted.

5.   Each Contestant’s design entry must be entered in one of the following three age categories:  

• ·         0-5 years
• ·         6-10 years
• ·         11-13 years

 Parents or guardians must choose the category for the Contestant during registration.

6.   Entries must be submitted no later than June 28, 2013, at 11:59 pm (EDT).

7.   Only work that is entirely the unique, original creation of the individual Contestant is eligible for the Challenge.  Do not submit work that contains anything traced or otherwise copied from any pre-existing material (such as clip art) even if it is “public domain” or “royalty-free.”  Works of which any part has been traced or otherwise copied from any pre-existing materials are not eligible.

8.   The following are not eligible to enter into the Challenge:     

• ·         Children of employees of the Department of the Treasury, including the United States Mint and other Treasury offices and bureaus;
• ·         Children of contractor employees who are performing work under a contract with the Department of the Treasury, including the United States Mint and other Treasury offices and bureaus;
• ·         Children of former contractors under the United States Mint Artistic Infusion Program;
• ·         Children of individuals involved in the design evaluation process, including the staff of the National Baseball Hall of Fame.

9.   Contestants, parents or guardians, design entries, and other application materials must fully comply with all Official Rules.  A failure to comply with any of the Official Rules may disqualify a Contestant or design entry. 

Design Rules

10. Artwork should reflect the theme, “What’s Great About Baseball.”

11. The theme must be depicted visually in one or a combination of media, such as acrylics, watercolor, pencil, charcoal, marker, spray paint, crayon, pastels or digital software.  

12. Designs must not include the name or depiction of any real player or other real person, whether living or dead.

13. Designs must not include the name, emblem, logo, or other indicia associated with any real baseball team, either professional or amateur.

14. Designs must not include any depiction of a real baseball stadium, arena, or field, either in whole or in part, whether or not currently existing or in use.

15. Inappropriate designs will not be considered or posted for public viewing and voting.

Challenge Procedures

16. All entries must be submitted on Challenge.gov.  A Contestant’s parent or legal guardian must establish a Challenge.gov account and submit the entry on the Contestant’s behalf.

17. Parents or guardians must scan or photograph the Contestant’s design entry and upload the design entry as a ZIP or PDF file. 

18. Challenge.gov allows loading a photograph to be associated with your account, and allows registration through Facebook®. We strongly encourage you to help keep children safe by ensuring that no photograph associated with your Challenge.gov account (including Facebook photographs) contains anyone under the age of 18.

19. United States Mint employees will review all entries for appropriateness and compliance with the Official Rules.  Entries that do not meet eligibility or design requirements, or do not fully comply with the Official Rules, will not be posted for public viewing.

20. Members of the general public will be able to vote for their favorite design in each grade category.

Winners

21. All Contestants will receive an acknowledgment letter.  This letter will be e-mailed to the parent or guardian e-mail address provided at the time of submission. 

22. There will be five winners in each age category, as determined by the number of public votes that each design receives.

23. Four winners in each age category will receive a National Baseball Hall of Fame Half-Dollar Clad Commemorative Coin. 

24. The design with the most public votes in each age category will be considered the overall winner for that age category.  Those three (3) Contestants will receive a National Baseball Hall of Fame $1 Silver Commemorative Coin. 

25. If the parent or guardian is officially notified that his or her Contestant’s design has been chosen as a winner, the parent or legal guardian must manually sign and submit a stand-alone Parental Consent Form (below, to include information that will permit the United States Mint to correspond with the parent or legal guardian) and Rights Transfer Agreement on the Contestant’s behalf, as required by the Official Rules or as instructed by the United States Mint.

26. All prizes are subject to eligibility requirements.

Rights

27. By submitting an entry on behalf of the Contestant, the submitting parent or guardian—

            a.   authorizes the Contestant to participate in the Challenge and to be bound by the Official Rules (including but not limited to the required Rights Transfer Agreements and other materials to be submitted in connection with the Challenge);

            b.   consents to the collection and use of the personal information of both the parent or legal guardian and the Contestant (such as name, likeness, school grade, home town, other biographical material and other identifying characteristics) for purposes such as identity verification, application processing, security vetting if performed,  and in connection with the posting of designs on the websites of the United States Mint and Challenge.gov, with the evaluation and voting process, and with publicity and promotion of the Challenge and United States Mint programs generally;

            c.   warrants and agrees (in addition to the other warranties in the Official Rules and the Rights Transfer Agreements) that—

                  (1)  the Contestant is the sole creator of the submitted design;

                  (2)  the submitting parent or guardian is legally authorized to enter agreements and otherwise act on behalf of the Contestant;

                  (3)  the submitting parent or guardian and the Contestant meet all eligibility criteria contained in the Official Rules; and

                  (4)  the submitting parent or legal guardian has read, understood and agrees to the Official Rules on his or her own behalf and on behalf of the Contestant.

            d.   releases and holds harmless the United States Government (including but not limited to the United States Mint and Challenge.gov), ChallengePost, Inc., and their respective components, parents, subsidiaries and affiliates, any other entities or organizations performing services in connection with the Challenge, and the respective past and present officers, directors, employees, contractors, agents, successors and assigns of all of the foregoing, from and against any and all claims, losses, expenses and liabilities (including reasonable attorneys’ fees) arising out of or relating to participation in the Challenge by the parent or legal guardian and the Contestant (including but not limited to all travel, promotion and publicity) or acceptance, use or misuse of any prize.

28. All entries (including, but not limited to, all intellectual property embodied in all entries) shall become the sole property of the United States Mint and will not be returned, whether or not selected as the Challenge winner.

Rights Transfer Agreement (Download PDF)

The Official Rules of the Kids’ Baseball Coin Design Challenge (“Challenge”) are incorporated by reference into this Rights Transfer Agreement.

In this Rights Transfer Agreement, the term “Entrant” is the parent or guardian of the Contestant who, in accordance with the Official Rules, is submitting a design (or revised design) in the Challenge on behalf of the Contestant, and who enters this Rights Transfer Agreement on both the Entrant’s and the Contestant’s behalves.

By entering the Challenge and in consideration of the possibility of being eligible for the honorarium, the undersigned Entrant hereby—

1.   transfers to the United States Mint in perpetuity all rights (including but not limited to all copyright and all other intellectual property rights) in all designs and revisions the Entrant submits to the United States Mint for this Challenge, and in all drafts of those designs and revisions even if not submitted to the United States Mint, all of which will become the United States Mint’s sole and exclusive property for any and all uses and purposes, even if (a) prepared before the Entrant entered the Challenge and agreed to this Rights Transfer Agreement or (b) not ultimately used by the United States Mint (this means that the Entrant will relinquish and not retain any rights at all in these designs, revisions or drafts, and without specific written permission will not be able to use or license or allow others to use them (or designs substantially similar to them), display them on a web site, or use or license an unused version or draft of a submitted design (or revised design) in any manner, even if it existed before the Entrant entered the Challenge or agreed to this Rights Transfer Agreement (including one covering any revision)).

      2.   agrees that, if the Official Rules or the United States Mint requires the Entrant to prepare and submit manually executed Rights Transfer Agreements, the Entrant must deliver them on the schedule and as additionally directed by the United States Mint to remain eligible in the Challenge.  The Entrant acknowledges that the United States Mint has the right to disqualify entrants who fail to properly sign and timely return required Rights Transfer Agreements.

      3.   agrees to waive and agree not to enforce any “moral rights,” such as rights of attribution and integrity, in the design and any revisions the Entrant submits (and in their drafts) and as they may be revised by the United States Mint for the various purposes contemplated by the Challenge, and waives and acknowledges that the Entrant will not be entitled to inspect or approve any design, revision, final design, finished product, or any other use of any design, including but not limited to advertising, marketing, promotional materials or merchandising products or materials.

      4.   in addition to the other warranties in the Official Rules, warrants that the Contestant alone created the design and any revisions the Entrant submits, all of which are entirely original, not previously published and not copied in whole or in part from other works (including public domain works, stock house works or “clip art”); any source materials (such as photographs or models) consulted in preparing the design and any revisions submitted were used only for reference and to ensure design element accuracy; and if, in spite of the foregoing, for any reason the Contestant’s design or revisions do contain or are based on third-party intellectual property (such as a photograph) or affect third-party rights (such as an individual’s name or likeness), before submitting the design the Entrant has (without assistance, payment, or prompting from the United States Mint) obtained all permissions necessary to ensure that the United States Mint will own all rights in the designs, revisions and any drafts, without restriction or any further action so as to, among other things, allow the United States Mint to own, use and allow others (such as licensees) to use or modify and use the designs and any revisions and derivatives in any manner in all media and markets now known or hereafter developed or discovered, worldwide, for commercial or other purposes in perpetuity without restriction, approvals, attribution, permissions or compensation.

      5.   indemnifies and holds harmless the United States Government against any claims arising from any one or more of the following:  breach of the Official Rules; breach of the Terms of Participation of Challenge.gov; breach of the terms of, or failure to provide accurate information on, any one or more Parental/Legal Guardian Consent Forms or Rights Transfer Agreements the Entrant submits; or infringement of copyright or other third-party rights related to any one or more designs or revisions the Entrant submits, their sources, or the use of such designs, revisions or sources.

      6.   consents to the collection and use of the of the personal information of both the Entrant and the Contestantpersonal information (such as name, likeness, school grade, home town, other biographical material and other identifying characteristics) for purposes such as identity verification, application processing, security vetting if performed, and public posting of designs on the websites of the United States Mint and Challenge.gov, with the evaluation and voting process, and with publicity and promotion of the Challenge, and United States Mint programs generally.

      7.   agrees to be responsible for all expenses of participation in the Challenge, including but not limited to all materials, postage, telephone, internet, and travel (other than those expenses of official travel to United States Mint facilities or other locations for which the United States Mint may expressly and in advance directly notify and invite the Entrant and agrees to bear expenses).

      8.   releases and holds harmless the United States Government (including but not limited to the United States Mint and Challenge.gov), ChallengePost, Inc., and their respective components, parents, subsidiaries and affiliates, any other entities or organizations performing services in connection with the Challenge, and the respective past and present officers, directors, employees, contractors, agents,  successors and assigns of all of the foregoing, from and against any and all claims, losses, expenses and liabilities (including reasonable attorneys’ fees) arising out of or relating to the Entrant’s participation in the Challenge (including but not limited to all travel, promotion and publicity) or acceptance, use or misuse of any prize.
